Judge appointment creates new controversy


A controversy has emerged between the Supreme Court Bar Association (SCBA) and the government over the appointment of judges in the Appellate Division.

The SCBA alleged that the government has appointed Tafazzul Islam as the judge of Appellate Division, superseding Justice Syed Amirul Islam.

Talking to the BBC Bangla service last night, Barrister Rokanuddin Mahmud, president of the SCBA, said the government had done this out of stubbornness.

"By making such an appointment, the government is trying to prove that they don't bend to any suggestion by the SCBA," said Rokanuddin Mahmud.

He alleged that this act of the government has tarnished the image of the Supreme Court.

Law, Justice and Parliamentary Affairs Minister Moudud Ahmed refuted the SCBA president by telling the BBC last night that there is no hard and fast rule under which judges of the Appellate Division must be appointed on the basis of seniority.

"It is only our tradition but there are instances that judges of the Appellate Division have been appointed ignoring the seniority status," said the law minister.

Terming the consultation with the SCBA as illogical, Moudud Ahmed said that such kind of consultation has no constitutional basis.
