Pak lawmakers asked to submit assets details


Election Commission of Pakistan has asked the members of the Parliament and provincial assemblies to submit statements of assets and liabilities with the Commission by September 30.

According to Election Commi-ssion sources, it is mandatory for every member of the parliament as well as members of provincial assemblies to submit their yearly statements of assets and liabilities of their own, their spouses and dependents under section 42A of the Representation of the People Act, 1976 and section 25A of the Senate (Election) Act 1975.

Section 42A provides that the Chief Election Commissioner shall notify the names of those members by October 15 who fail to file statements of assets and liabilities within the period specified in sub-section (I) and by an order, direct that such member shall cease to function till such statement is submitted.

Moreover, any member who submits the statement of assets and liabilities under sub-section (I) which is found to be false in material particulars, may be proceeded against under section 82 for committing the offence of corrupt practice.

Section 42A for yearly submission of statements of assets and liabilities also provides that every member shall, on a form prescribed under clause (f) of sub-section (2) of section 12, submit a statement of assets and liabilities of his own, his spouse and dependents annually to the Commission by September 30 each year.

The statements of assets and liabilities submitted under sub-section (I) shall be published in the official gazette.

Section 25A also provides that if a member submits the statement of assets and liabilities under sub-section (I) that is found to be false in material particulars, he may be proceeded under section 62 for committing the offence of corrupt practice.

As laid down in sub-section (2) of Sections 42A and 25A of the Acts, on receipt, the statements shall be published in the official gazette.

Moreover, any member whose statements of assets are found false in material particulars, he may be proceeded against, as well, under Sections 82 and 62 respectively of the said Acts as these fall under the offenses of corrupt practices.

The sources said, in terms of sub-section (3) of Sections 42A and 25A of the Acts, the members of the Parliament or Provincial Assem-blies, who fail to file to the statements of assets and liabilities within the specified period shall cease to function as members till the submission of such statement.

The Election Commission has asked the members to submit the statement of their assets and liabilities within due date to avoid legal consequences.
