HC asks why case should not proceed

The High Court yesterday issued rule asking the respondents to explain why trial of special criminal case against Mustafa Kamal, police super of Sylhet and others, pending at Dhaka Metropolitan Sessions Judge's Court should not proceed.It also issued show cause as to why the government should not be directed to approve prosecution of the accused persons. The rule came upon a writ filed by Salahuddin Ahmed, proprietor of SA Paribahan. The division bench of justices M Joynul Abedin and Sharif Uddin Chaklader issued the rule, returnable in two weeks. The respondents are SP Mustafa Kamal, principal secretary to prime minister and Dhaka Metropolitan Sessions Judge. Salahuddin had earlier complained to the court that SP Mustafa Kamal and SI Wahid Mia demanded a bribe of Tk 50 lakh. On refusal, Salahuddin was detained, physically tortured and implicated in fabricated criminal cases. The allegations were established prima facie in judicial inquiry and the report was submitted to the Sessions Judge's Court for trial. But the police officers could not be brought to book without approval of the prime minister's secretariat, which was refused. Advocate Mahbubur Rahman MP stood for the petitioner.
