Suit filed against SCBA resolution


A civil suit claiming illegal the resolution of the Supreme Court Bar Association (SCBA) on August 29 threatening immediate expulsion of a member for attending the Court of Chief Justice was filed yesterday.

Advocate Sigma Huda filed the suit with the Fourth Assistant Judge's Court, Dhaka making defendants SCBA President Barrister Rokanuddin Mahmud, General Secretary Advocate Bashir Ahmed and all members of its executive committee.

After hearing, Judge Mohammad Anisur Rahman imposed ad interim injunction on the defendants until disposal of the original suit.

The court also issued notice upon the defendants to explain in seven days why a temporary injunction will not be imposed upon them.

In the plaint, Sigma Huda said the SCBA on August 29 decided to boycott the chief justice's court indefinitely from the next day, as he ignored their demand for cancellation of the swearing-in of 19 new additional judges appointed on 'political grounds'.

The SCBA at an emergency general meeting decided that any member including the attorney general will be expelled from the Bar for failure to comply with the boycott decision.

The meeting took a resolution against the appointment of the 19 judges of the High Court Division calling for cancellation of their appointment or for their resignation, the plaintiff said.

The resolution taken by the SCBA on August 29 is illegal, arbitrary, without any lawful basis, void and of no legal effect, the plaintiff added.

Advocates Lutfe Alam, Sanaullah Miah, and Masud Ahmed Talukdar conducted the suit on behalf of the plaintiff.
