Sedition Case Against Adv Faridul
HC stays its Aug 23 order

The High Court (HC) yesterday stayed its August 23 order that directed the Supreme Court (SC) registrar to file a sedition case with Ramna Police Station against Advocate Mohammad Faridul Alam for committing contempt of court by burning a copy of a High Court order. The order was issued on May 23, banning agitation on the Supreme Court premises. After hearing a petition filed by Mohammad Faridul Alam seeking a stay on the High Court order, a bench comprising Justice MA Matin and Justice Mamnoon Rahman fixed October 25 for hearing the petition. The same bench on August 23 had issued a contempt rule on Advocate Faridul Alam, a leader of Cox's Bazar Bar Association, after Supreme Court lawyer Noor Hossain Chowdhury brought contempt proceedings against Alam the same day. The bench also asked Alam to show cause why punishable measures should not be taken against him for committing contempt of court for burning the copy of a High Court order. The court had also ordered him to appear in person before the bench on October 25 to explain his position in this regard. Dr Kamal Hossain, Barrister M Amir-ul Islam, Supreme Court Bar Association President Advocate Mahbubey Alam, Secretary Advocate M Enayetur Rahim and Advocate Ramjan Ali Skikdar appeared for the petitioner. On July 29, Sammilita Ainjibi Samannoy Parishad (SASP), a pro-opposition lawyers' body, organised a grand rally of the lawyers on various demands, including implementation of the Supreme Court's 12-point directives for separation of judiciary, appointing the judges on the basis of honesty, efficiency and talents, and freeing the judiciary from politicisation. Addressing the rally, Advocate Faridul Alam expressed anger on the High Court ban on the lawyers' agitation and also reportedly burnt a copy of the judgement on the stage. SASP leader and Bangladesh Bar Council Vice-Chairman Barrister Rokanuddin Mahmud sought apology and expressed regret on behalf of the SASP and Faridul Alam for his act at the rally.
