Non-functioning of ACC
Absence of rules main cause: Justic Sultan


Anti-Corruption Commission (ACC) Chairman Justice Sultan Hossain Khan yesterday said the absence of rules and organogram is the main reason for the non-functioning of the anti-graft watchdog.

Talking to UNB, Justice Sultan dismissed the allegations that ACC could not be functional because of internal problems saying that there are indeed differences of opinions but not internal feud.

"There is a procedural dispute between two commissioners--Prof Moniruzzaman Miah and Monir Uddin Ahmed,” he said.

"Monir Uddin Ahmed is of the opinion that rules are not mandatory for submitting charge sheets, but the view is opposed by Moniruzzaman."

He said he believes that having rules is good to submit charge sheets, but not absolutely mandatory. "There will be no harm to the cases or the accused will not get any benefit if the charge sheets are submitted before the approval of the rules."

He said the Commission has already approved of submitting charge sheets in 45 corruption cases. "Within a couple of days charge sheets of these 45 corruption cases will be submitted."

Strongly refuting the report that he would resign if ACC could not be fully functional in seven days, Justice Sultan categorically said, "I never specified the date"I said I will certainly resign if ACC could not be made fully functional."

He said the government has promised him of approving rules and organogram by this month and after the approval the ACC will begin its activities in full swing.

After more than a year of its inception, the ACC could not be fully functional because of various reasons.

Although the government's failure to approve the rules and organogram could be the reason for that, it is widely perceived that one of the main causes for nonfunctioning of the commission is internal feud among the chairman and the two commissioners.

Since its inception on November 21, 2004, the ACC was subject to criticism from all quarters including donors. The donors want the ACC to be fully functional for combating rampant corruption across the country.
