Kibria Murder Case
SC rejects leave to appeal petition against HC order


The Supreme Court (SC) yesterday rejected the leave to appeal petition against a High Court (HC) verdict that affirmed the lower court's order, rejecting the plea for further investigation into former finance minister Shah AMS Kibria murder case.

Within three hours of charge framing by the Speedy Trial Tribunal, Sylhet, against 10 accused of Kibria killing, the Supreme Court on February 7 stayed all proceedings of the case upon a petition seeking leave to appeal by the complainant of the case.

On November 21 last year, the High Court discharged a writ petition that sought further investigation into the murder case. The court in its observation said it has "no jurisdiction" to order further inquiry into a case pending with the trial court.

Kibria, also an Awami League (AL) lawmaker, and four others were killed in a grenade attack on a rally at Baiddyerbazar in Habiganj on January 27 last year.

Within two months of the incident, Senior ASP of the CID Munshi Atiqur Rahman submitted the charge sheet to the court against 10 suspects. The complainant, Abdul Majid Khan, disapproved of it claiming that the charge sheet was submitted without any in-depth inquiry, leaving out the masterminds and source of the grenade.

After hearing both sides, a three-member bench of the Appellate Division headed by Chief Justice Syed JR Mudassir Husain passed the order vacating its earlier order of staying operation of the trial pending with the Sylhet Speedy Trial Tribunal. The two other members of the bench are Justice MM Ruhul Amin and Justice Amirul Kabir Chowdhury.

Dr Kamal Hossain stood for the petitioner while Additional Attorney General Abdur Rezzaque Khan for the state.
