IO has to explain discrepancy in charge sheet


A Chittagong court yesterday issued a show cause notice to the investigation officer (IO) of the sensational Jamal Uddin abduction and murder case for discrepancy in the charge sheet he submitted on July 11.

The Court of Metropolitan Magistrate (CMM) Akram Hossain issued the order against IO Anwar Hossain, an inspector of Criminal Investigation Department (CID) of police, during the hearing on the charge sheet and as the prosecution filed a discontent petition in this regard.

In the notice, the court asked the IO to show cause as to why Kala Mahabub, who received the court's approval to be a 'state witness' [Rajsaxmi], was included as one of the sixteen people accused.

It may be mentioned, the court had earlier granted an appeal made by the IO himself to produce Kala Mahbub as state witness during the trial of the case.

Sources said the inclusion of Kala Mahbub in the charge sheet is a contempt of court order.

The hearing on the charge sheet and of the discontent petition started around 4:00pm yesterday. The hearing continued for over an hour.

Chowdhury Farman Reza Liton, the eldest son of the victim Jamal Uddin Ahmed Chowdhury, filed the discontent petition pointing out 11 'discrepancies' and 'irrelevancies' in the charge sheet.

The court fixed July 31 for the continuation of the hearing on the charge sheet and the discontent petition.

The charge sheet indicted 16 people including two prime accused Kashem Chairman and Shahid Chairman. The charge sheet however spared Maruf Nizam, brother of a local ruling party legislator.

Family members of Jamal Uddin had repeatedly been accusing Maruf Nizam as the mastermind of the abduction and murder.

Jamal Uddin was kidnapped on July 24, 2003 as he was returning to his residence at Chandgaon from his business firm at Chawk Bazar. He was later killed.
