Experts for SC advice on poll timeframe

Constitution experts yesterday suggested the government should seek legal advices from the Supreme Court (SC) regarding whether it is mandatory to hold the election within the 90-day timeframe.They also termed the prevailing political situation following the grand alliance's decision to boycott the election as volatile. MA Zahir, a constitution expert, said, "The country has definitely reached near to a Tsunami." He said the government should seek legal opinion from the SC whether it is mandatory to hold the election within 90 days of the caretaker government. According to justice Naimuddin, the voter list is 'totally illegal.' He said, "It is not only illegal but also invalid, which means it does not have any existence within the purview of the law." "If an election takes place on the basis of the current voter list, it will be counted as invalid," he added. Naimuddin also expressed surprise as none of the 64 deputy commissioners raised the issue of not having the voter list. "How come they did not place the issue?" he said. Shahdeen Malik, a lawyer, advocated for the spirit of the constitution rather than its literal meaning. He said, "As people are the source of all power (according to Article 7 of the constitution) and it is the people who will decide on who will form the government and who will be in the opposition." "If people can not exercise the power, discharge this responsibility, which will be the real violation of the constitution."
