Seminar held in Dept. of Law, CU

Tabassum Mokhduma

A law talk as held in the Conference Room of the Department of Law, University of Chittagong (CU), on March 17, 2008, which was widely-attended by students and teachers of this Department and also by teachers of the Premier University. Werner F. Menski, Professor of South Asian Laws at the School of Oriental and African Studies at the University of London, gave the talk on what is law, and how do we study, teach and apply it? The objectives behind this seminar was to encourage law students and others to study and deal with law in an unconventional way, that is to say, both by becoming sensitized about law's local specificity and critically accepting global norms. Associate Professor Dr. Abdullah Al Faruque, Chairman of the Department, presided over the seminar while Associate Professor Zakir Hossain, Dean of Faculty of Law, gave the welcome speech and Dr. Ridwanul Hoque gave a note of introduction on the speaker. Other notables present were Professor Dr. M. Shah Alam, Ex-Dean, Faculty of Law, CU, Professor Mahfuzul H. Chowdhury of the Department of Politics, and former Vice-Canceller Professor Alamgir M. Serajuddin.

In this seminar, Professor Menski mainly focused on law's pluralistic nature, and argued that law is not static, but rather dynamic. The 'Law' is in constant need of being negotiated, modified, and navigated with the help of a number of factors including culture, social norms, and religious ethics, the speaker told the audience. Following Professor Menski's talk, Prof. Shah Alam and Prof. Alamgir Serjuddin gave their critical and appreciative comments. Prof. Alam drew the audience's attention to whether a uniform family code in Bangladesh would be possible at some point.

Several students actively took part in the open sessions and came up with diverse, intelligent questions concerning, among others, the local applicability of certain basic international norms, the extent of legal pluralism, and Islamic criminal law and its punishment methods. Before the Chair wrapped up the seminar, Prof. Menski quickly responded to those questions and gave some illustrations in support of his views.
